A Legal Obligation Assessment is linked to your Record of Processing Activities. If the legal basis for your activity is Legal Obligation, Responsum will generate a suggestion to create a Legal Obligation Assessment for this activity.
Through the Legal Obligation Assessment, you are able to demonstrate that the processing is necessary to comply with a certain Law, Regulation, Directive, etc. and that it does not go beyond what the law requires.
To create a legal obligation assessment, there are two ways:
- Hover over Privacy and Click on Legal Obligations. On the overview page, on the top right, click on the Create button to start documenting your legal obligation assessment.
- You can also create a legal obligation assessment from Suggestions. While creating a processing activity, choosing Legal Obligation as the legal basis for processing will trigger a suggestion to create a legal obligation assessment for this particular activity. From the Bulb Icon at the top bar, click on Create an Item and you will land in the Legal Obligations submodule automatically. Make sure to read the article on Suggestions to get a better understanding of how these functionalities work.
If you choose to create a Legal Obligation Assessment from suggestions, the Name and Processing Activity fields will be filled out automatically as it is linked to the particular processing activity you chose to create the assessment from.
In the Legislation relation field, you can choose the relevant legislation which contains the legal obligation that is linked to the processing activity from a dropdown list. You can also add a new legislation on the spot from the plus icon to the right of the field when necessary. To provide more details, you can state the specific article which states the legal obligation in the Specific Article field.
Set a Review Interval to demonstrate the frequency of checking and updating the assessment as regarded necessary. A date for Next Review Due will be automatically generated based on the Review Interval input.
After having filled out the relevant fields, click on Create. Your new record will show in the overview of the Legal Obligations when you open this specific sub-module. If you open the relevant processing activity in your Record of Processing Activity sub-module, you will be able to see the Legal Obligation Assessment linked to it from the Linked Items icon at the top bar.
